PRIVACY POLICY

This Privacy Policy (hereinafter referred to as “Policy”) shall govern (i) the manner in which Performly collects, uses, disclose and maintains Your Contact Information, Non-Personnel Information, Additions and Communications obtained when You access, use Performly’s Website and\or subscribe on the Online Service(s), and (ii) the privacy of Your Content.

By accessing, using Performly’s Website and\or subscribing on the Online Service(s), You agree to comply with and be legally bound by this Policy.

Your access, use to Performly’s Website and\or subscribing on any of the Online Service(s) shall be deemed Your acceptance of the Policy. In the event You disagree on the Policy, You are advised to stop accessing, using Performly’s Website and\or subscribing on the Online Service(s).

The Policy may be subjected to change from time to time and such changes shall be effective upon being integrated on Performly’s Website, accordingly You are advised to refer back to the Policy from time to time. Performly may notify You by the occurrence of the changes made to the Policy upon You create an account on the Performly’s Website. Performly disclaims any liability in the event You don’t receive Performly’s notice.

If You don’t agree to such changes, Your sole remedy is to stop accessing, using Performly’s Website and\or subscribing on the Online Service(s). Your continuous access, use to Performly’s Website and\or subscription on the Online services shall be deemed as an acceptance to such changes.

To the extent that may differ with the Agreement, this Policy shall prevail.

DEFINITIONS

- Active Users: means Your employee(s) who are using the Online Service(s), including White Collar and\or Blue Collar.

- Additions: means any feedback, ideas, invention, recommendations, post, suggestions or comments added by You or by a third party on Performly’s Website and\or on Your account.

Agreement: means the document related to the legal terms and conditions which is posted on Performly’s Website.  

- “Blue Collar” means an Active User who is a working-class person performing manual/physical work.  

- Communications: means all information that You give to Performly in any way, including with no limitation email, telephone or other communications.

Contact Information: means information that identifies You including with no limitation Your name, email address.

Inappropriate Content: means unlawful data, obscene, indecent, pornographic, seditious, offensive, defamatory, threatening, liable to incite racial hatred or acts of terrorism, menacing, and blasphemous content inserted from Your side.

Non-Personnel Information: means the data that doesn’t identify You and collected automatically including with no limitation the ip address.

Online Service(s): means the online service(s) that You subscribe on them through Performly’s Website which are as follow:

(i) Intra and payroll;

(ii) Intra; and\or

(iii) Talent.

Performly: means Performly International, Inc.

- Performly’s Website: means the website of Performly International, Inc. www.performly.com. 

-  White Collar: means an Active User who is working in an office or other professional environment.

-  You: means the person, firm or company who access, use Performly’s Website and\or subscription on any of the Online Service(s) (hereinafter referred to as “You” or “Your”).

Your Content: means all information, data and documents related to You and to Your Active Users including with no limitation all financial information or images that You add on the Online Service(s). 

1. PERFORMLY SHALL COLLECT THE FOLLOWING INFORMATION

1.1 Contact Information

Performly may collect Your Contact Information only if You submit it voluntary. You can refuse to submit Your Contact Information, and in this event You shall not be able neither to create Your account on Performly’s Website nor to subscribe on the Online Service(s).

1.2 Non-Personnel Information

Performly may collect Non-Personal Information about You whenever You access and use Performly’s Website. Non-Personal Information may include the browser name, IP address, user ID, the type of the computer and Your technical information such as means of connection to Performly’s Website, operating system and internet service providers utilized and other similar information.

1.3 Performly may collect Your Addition(s) and Communications. In the event You shall contact Performly for support, Performly will keep an internal record of what support was given.

2. PERFORMLY SHALL USE THE AFOREMENTIONED INFORMATION AS FOLLOW:

2.1 Performly may use Your Contact Information, Additions and Your Communications (i) to inform You by the functionality changes to the Online Service(s), Performly’s Website, Performly’s new services, Performly’s update and special offers that You may find valuable; (ii) to update You in the event Performly shall make a survey or advertising and publicity; (iii) to protect Performly’s Website and Online Service(s) against any abuse, breach or fraudulent transaction; and\or (iv) to improve Performly’s Website and Online Service(s).

2.2 Performly may use Your Non Personnel Information (i) to personalize search results and to customize Performly’s Website and Online Service(s) in accordance with Your preferences; (ii) to diagnose problems with Performly’s server; (iii) to know how You are using Performly’s Website; (iv) to personalize the online ads that Performly present to You based on Your ads viewed; (v) to improve Performly’s Website and Online Service(s); (vi) to protect Performly’s Website and the Online Service from any abuse, breach or fraudulent transaction; and\or (vii) for any purpose related to Your Online Service, if any.

2.3 Performly gather broad demographic information to improve Performly’s Website and make Your browsing and subscribing experience more enjoyable. This is not linked to any Contact Information, except as necessary to prevent fraud or abuse on Performly’s system.

3. CONFIDENTIALITY

3.1 Performly undertakes to keep the confidentiality of Your Contact Information and Communications, and Performly will not authorize the disclosure of Your Contact Information and Communications to a third party unless upon the occurrence of any of the following events: (i) in the event the disclosure is required by law, required by the Policy and Performly’s legal terms and conditions; (ii) in the event a third party shall fulfil certain functions on behalf of Performly and such third party is in a need to know such Contact Information and\or Communications, provided that such third party will be prohibited from using Your Contact Information and\or Communications for any other purpose; (iii) in the event You agree on such disclosure; and\or (iv) in the event Performly needs to take precautions against liability, to investigate and defend Performly against any third-party claims or allegations.

3.1.1 Performly may share generic aggregated demographic not linked to any of Your Contact Information with Performly’s business partners and trusteed affiliates.  

3.2 Performly reserves the right to disclose the Additions, Your Non- Personnel Information to any third party at any time for the interest of Performly.

3.3 Regarding Your credit card, Performly has no access to Your credit card while subscribing on the Online Service(s).

4. SECURITY

4.1 Performly operates secure data networks protected by industry standard firewall and password protection systems. Performly security is periodically reviewed and enhanced as necessary, and only authorized individuals have access to Your Contact Information and Communications. Performly takes steps to ensure that Your Contact Information and Communications are treated securely and in accordance with the Policy.

4.2 Performly cannot guarantee that Your Contact Information and Communications shall not be subject to any loss, destruction, alteration or disclosure. When You provide Performly with Your Contact Information and Communications, You do so at Your own risk. Performly shall notify You in the event of a material breach of security, which results in an unauthorized disclosure of Your Contact Information and\or Communications.

4.3 You are responsible of the privacy and security of Your account’s password, and Your Content. You must take all reasonable steps to protect Your account’s password and Your Content and to comply with all applicable laws and regulations

4.4 You should notify Performly at support@performly.com upon You need to deactivate Your login or change Your account’s password.

4.5 Remember, when You use online tools such as Performly’s forums, community sites, or social networking sites, the content You upload to them will be public. If You don’t want any content that You upload to be seen by the rest of the world, please don’t post it.

5. TRANSFER OF DATA ABROAD

In the event You are visiting Performly’s Website from a country other than Egypt, Your communications with Performly may result in the transfer of information across international boundaries. Furthermore, You acknowledge and agree that in order to best and promptly serve Your requests and/or issues, Performly’s customer support, including support provided via telephone and chat, are in Egypt. Accordingly, when You originate a call or chat from Your country of residence, the call or chat will be supported by a representative in Egypt, and that such information provided will be transferred to Egypt. In any event, Your information will be processed in accordance with the Policy. By visiting Performly’s Website, calling or chatting with Performly, You consent to such transfers.

6. DO NOT TRACK SIGNALS

Your browser settings may allow You to automatically transmit a “Do Not Track” signal to websites and online services You may visit. There is no consensus among industry participants as to what “Do Not Track” means in this context. Like many websites and online services, Performly currently doesn’t alter its practices when Performly receives a “Do Not Track” signal from a visitor’s brows.

7. DELETION OF YOUR ACCOUNT

In the event of deleting Your account, Your Contact Information shall be deleted. Performly may retain certain Contact Information by virtue of law and for Performly’s business purposes.

8. COMPLAINS

8.1 In the event You shall have any inquiry or complaint related to the Policy, You are kindly requested to contact Performly at support@performly.com

8.2 Performly will investigate the matter and revert back to You in order to resolve Your concern(s).

9. THE PRIVACY OF YOUR CONTENT

9.1 Performly understands that Your Content is confidential and contain sensitive information. Accordingly, Performly does not share or permit third parties to access Your Content.

9.2 Although Performly uses a number of security measures to make sure that Your Content is secured, Performly cannot guarantee that Your Content shall not be subject to any loss, destruction, alteration or disclosure. When You provide Performly with Your Content, You do so at Your own risk. Performly shall notify You in the event of a material breach of security, which resulted in unauthorized use or disclosure of Your Content.

10. COOKIES AND WEB BEACONS

10.1 Performly’s Website uses "cookie" and "web beacon" technology. "Cookies" are short pieces of data generated by a web server that a website stores on a user's computer. Certain pages on Performly’s Website may require the use of a cookie for purposes of keeping information You enter on multiple pages together. Cookies also enable Performly to customize Performly’s Website and offerings to Your needs and provide You with a better online experience with Performly. In addition, cookies are used to:

(i) measure usage of various pages on Performly’s Website to help Performly make Performly’s information; more pertinent to Your needs and easy for You to access;

(ii) identify and categorized the internet webpages from which the visitor came to Performly’s Website and observe the browsing patterns; and

(iii) provide functionality such as online orders, Performly services and other functionality that Performly believe would be of interest and value to You.

10.2 The types of cookies that Performly use are referred to as "session" cookies and "persistent" cookies. Session cookies are temporary and are automatically deleted once You leave Performly’s Website. Persistent cookies remain on Your computer hard drive until You delete them. Performly do not use cookies to gather information concerning Your visits to other websites, nor ascertain any personally identifiable information about You apart from what You voluntarily provide Performly in Your dealings with Performly. Cookies do not, under ordinary circumstances, corrupt or damage Your computer, programs, or computer files.

10.3 In addition, the service providers Performly use to serve and host our advertisements, and/or deliver Performly e-mails use session and persistent cookies, to track the number of times Performly’s Website is accessed and whether the site was accessed from an advertisement. There are no cookies in the advertisements or e-mails. A cookie is placed on Your computer only if and when You click on an advertisement or open the e-mail. The cookie generated from the advertisement or e-mail does not contain any personally identifiable information and will remain on Your hard drive until You delete it.

10.4 You may set Your browser to block cookies (consult the instructions for Your particular browser on how to do this), although doing so may adversely affect Your ability to perform certain transactions, use certain functionality and access certain content on Performly’s Website.

10.5 Web beacons are used in combination with cookies to help website operators understand how visitors interact with their websites. A web beacon is typically a transparent graphic image (usually 1 pixel x 1 pixel) that is placed on a site. In contrast to cookies, which are stored on a user's computer hard drive, web beacons are embedded invisibly on Web pages and are about the size of the period at the end of this sentence. These web beacons are not tied to personally identifiable information. The use of a web beacon allows the site to measure the actions of the visitor opening the page that contains the web beacon. It makes it easier to Performly and records the activities of a recognized browser, such as the path of pages visited at a website. If this data is made available, none of the information will be personally identifying information or potentially personally-identifying information.
